RWU - NCAA Student-Athlete Sexual and Interpersonal Violence Disclosure Policy

PURPOSE OF POLICY

On April 27, 2021, the National Collegiate Athletic Association (“NCAA”) Board of Governors issued a revised Policy on Campus Sexual Violence which requires students participating in NCAA sports to annually disclose any prior conduct resulting in discipline through a Title IX and/or sexual misconduct proceeding, or criminal conviction for sexual, interpersonal, or other acts of violence. Additionally, the NCAA requires its member institutions to have a written procedure which directs its staff to gather discipline information involving incidents of sexual violence, interpersonal violence, and other acts of violence, as defined below.

This document describes Roger Williams University’s (“RWU”) policy and procedures regarding implementation of the NCAA Board of Governors Policy on Campus Sexual Violence.

DEFINITIONS

The NCAA Board of Governors Policy on Campus Sexual Violence has defined the terms “sexual violence”, “interpersonal violence”, and “other acts of violence” as:

  • Sexual Violence: a term used to include both forcible and nonforcible sex offenses, ranging from sexual battery to rape
  • Interpersonal Violence: violence that is predominantly caused due to the relationship between the victim and the perpetrator, including dating and domestic violence
  • Other Acts of Violence: crimes including murder, manslaughter, aggravated assault or any assault that employs the use of a deadly weapon or causes serious bodily injury
 

SCOPE

This Roger Williams University NCAA Student-Athlete Sexual and Interpersonal Violence Disclosure Policy (“Policy”) applies to all current, incoming, and transfer student-athletes (“student-athletes”) participating in NCAA sports at Roger Williams University.

POLICY

RWU Student-Athletes

Per the NCAA Policy, all current, incoming, and transfer student-athletes must complete an annual disclosure form stating whether they have engaged in prior conduct resulting in discipline through a Title IX and/or sexual misconduct proceeding, or criminal conviction for sexual violence, interpersonal violence, or other acts of violence. Student-athletes transferring from a NCAA member institution to RWU are also required to disclose discipline information and whether a Title IX and/or sexual misconduct proceeding, in which they are the Respondent, was pending, or incomplete, at the time of transfer.

The athletics staff will collect disclosure forms annually and will take reasonable measures to confirm the responses to determine a student-athlete’s eligibility. These measures include, but are not limited to, contacting a student-athlete’s previous institution of higher education or high school. As indicated in the NCAA Policy, all NCAA member institutions, in a manner consistent with federal and state law, must share relevant disciplinary information and notice of any pending, or incomplete, Title IX and/or sexual misconduct proceedings with other member institutions when a student-athlete attempts to enroll in a new college or institution.

Although disclosure of prior conduct resulting in discipline does not automatically result in penalties (e.g., ineligibility to participate in athletics or loss of athletics-related financial aid), Roger Williams University reserves the right to review incidents, and respond accordingly, with regard to the expectations detailed in the RWU Title IX Sexual Harassment Policy and Procedures and the RWU Student Code of Conduct. Additionally, a student-athlete’s failure to fully and accurately disclose this information could result in penalties, as determined by RWU.

RWU Student-Athletes Applying or Transferring to Other Institutions

If another NCAA member institution inquires about a student-athlete that was previously enrolled at RWU, then RWU will disclose if that student left the institution with a pending, or incomplete, Title IX and/or sexual misconduct proceeding or has a criminal conviction for sexual violence, interpersonal violence, or other acts of violence.
